Judge Walton had to decide whether the lawyers of Roger Clemens had the right to full access to all documents prepared by DLA Piper when investigating the use of enhancing drugs in Major League Baseball. DLA Piper had withheld the documents completely on the ground of attorney work product doctrine. Judge Walton drew the line between “fact work” and “opinion work” as to protect the latter while still giving the Clemens lawyers access to the facts contained in the material, i.e. the statements of the two witnesses in their own words.
