The New Jersey Supreme Court has proposed that eyewitnesses need to be treated with more vigilance. The judges have been instructed to carry out pretrial hearings to establish all possible variables to the eyewitness evidence. This is said to be done to administer jury instructions that clarify possible variables explicit to the case that might have eroded from the witness’ memory of the incident.
