Gabriel Aubry, according to TMZ, was booked for misdemeanor battery in November 2012. According to his booking sheet, the former lover of Halle Berry is listed as 6’2″ and 180 pounds. Aubry, a French-Canadian model, who fathered a child with Berry, continues to be in custody. Born in Montreal, Quebec, the model’s bail has been set at $20,000.

Sources inform TMZ that when Aubry got into a fight with Olivier Martinez, Berry’s fiancé. When the two fought, Berry rushed Nahla inside a house so the girl did not watch the brutality.

Aubry, who has modeled for Tommy Hilfiger, Gianni Versace, Valentino, Trussardi, Calvin Klein, DKNY, and Nautica, has been released from the hospital. Aubry is presently at a Los Angeles jail where he is being booked. Berry’s finance was also hospitalized. He returned to Berry’s home.

Aubry was arrested Thanksgiving morning, according to TMZ. Law enforcement sources reported to TMZ that Aubry showed up at Berry’s house with Nahla for a custodial hand-off. Aubry once had brighter days when he appeared in a Macy’s commercial in 2008 as part of an exclusivity with Calvin Klein along with Martha Stewart, Donald Trump, Mariah Carey, and Carlos Santana.

Aubry, known as the only male model to ever appear on the cover of L’Uomo Vogue while appearing in four different designers’ campaigns at the same time, in the same magazine, apparently pushed Berry’s fiancé, and tried to punch his face.

Berry’s fiancé blocked Aubry’s punch and Aubry struck Martinez’s shoulder. Aubry has been listed on People Magazine’s ‘Most Beautiful People’ List. Though Aubry is a top earning male model who can find many women interested in him romantically, he allegedly did not care about getting into legal troubles, and pushed Berry’s fiancé to the ground. Aubry suffered a broken rib, in the struggle. He also had contusions on his face, and possibly a serious head injury.

Martinez may have broken his hand and suffered neck injury. Martinez’s father was a professional boxer, and Martinez boxed competitively for several years prior to an acting career.



Abry is age 36, and Nahla is age 4. Aubry will appear in court on December 13, 2012. According to PEOPLE, a court granted an emergency protective order requiring Aubry to stay 100 yards away from Berry, Martinez, and Nahla. The fight follows a court decision denying Berry the right to relocate Nahla to France. Aubry and Berry did not marry. Apparently Abry does not want Berry, an ex-girlfriend, to take his daughter far away.
