Apple Lost the Bid

Apple Inc. lost a bid to stop appointed monitor Michael Bromwich from conducting interviews with company officials and board member Al Gore, after a judge found that the company conspired to fix e-book prices. The judge ruled that court-appointed antitrust monitor Michael Bromwich would stay on to make sure that Apple is complying with various court orders. US District Judge Denise Cote said there was “nothing improper” about a declaration filed by a lawyer chosen to serve as monitor, Michael Bromwich, that became the basis of Apple seeking his disqualification. Judge Cote said she will promptly issue a decision explaining her reasoning. Apple will then have 48 hours to seek an emergency stay from the federal appeals court in New York, she said. Bloomberg News reported that Theodore Boutrous, a lawyer for Apple, said Apple would appeal, and according to Yahoo News, a spokeswoman for the Justice Department declined to make an immediate comment.

Apple is the world’s second-largest information technology company by revenue after Samsung Electronics and the world’s third-largest mobile phone maker after Samsung and Nokia. Apple is the largest publicly traded corporation in the world by market capitalization, with an estimated value of US $415 billion as of March 2013.
