David Keith Hathaway Charged in Theft of Panties

David Keith Hathaway is a town marshal from Millersburg, Indiana. Hathaway is facing criminal charges after reportedly admitting to stealing underwear that belongs to the girlfriend of his son, according to the Huffington Post, the Associated Press and WSBT.

Hathaway has already been charged with two counts of conversion, which equates to a class A misdemeanor. The girlfriend of the son lives in Hathaway’s house.

The victim told Indiana State Police that she thought something was wrong back in October of 2013. This is when she discovered a pair of her panties in a plastic storage bag with several other pairs from other women. The bag was in a safe that belongs to Hathaway, according to The Elkhart Truth.

The girl and the son confronted Hathaway about the panties and he said that it was a joke.

The victim then found a second pair of her panties under her bed that were wet and crumbled. This is when she and the son put a hidden camera in the room to find out what was happening.

The video showed Hathaway going into the room, selecting a pair of panites left on the floor and then sniffing them, according to the affidavit. The video showed him replacing the panties and taking another from the floor.

Hathaway is facing up to one year in prison and a fine of no more than $5,000. He is scheduled to appear in court on August 15. The state of Indiana released the following statement:



“The Elkhart County Prosecuting Attorney charged David Keith Hathaway, 59, the Marshal of Millersburg, Indiana, with two counts of criminal Conversion, a Class A misdemeanor, in Elkhart Superior Court 6, today; and, a summons will be issued by the Court for his appearance. Conversion is the crime of exerting “unauthorized†control over property of another person.

The Indiana State Police Investigation determined that in October, 2013, and again in February, 2014, Hathaway maintained unauthorized possession of women’s underwear belonging to another, and for an unauthorized purpose. The Office of the Prosecuting Attorney has notified the Millersburg Town Council of the filing of charges.

Conversion is punishable by up to one year in jail, and a fine up to $5000.”
