Orrick, Herrington & Sutcliffe Adds Five Supreme Court Clerks to Its Practice

Summary: Five attorneys, all previous clerks for Supreme Court Justices, have joined Orrick, Herrington & Sutcliffe.

Five former U.S. Supreme Court clerks have joined Orrick, Herrington & Sutcliffe, Law.com reports. Three of the clerks recently finished their clerkships with the Supreme Court, and the other two are veteran clerks.

Partner Mark Davies proudly stated that the firm has grown from a single partner to five partners, fifteen associates and three special counsel in just a four-year period. “Rather than a single star partner, we have a constellation of first-chair partners who can each handle any appeal no matter the stakes.†Davies also said that the firm’s “highest priority†is “to recruit the most talented attorneys possible to come and join the fun.â€

Kelsi Corkran, previously of the U.S. Department of Justice’s civil appellate staff, and law clerk to Justice Ruth Bader Ginsburg, will join Orrick, Herrington & Sutcliffe as a partner in the Washington office. Corkran served as lead counsel in over thirty appeals and presented oral arguments in twenty-four cases before ten federal courts of appeals. Corkran has also been employed at the White House, and assisted with Justice Sonia Sotomayor’s confirmation. She was recently named as one of 40 rising stars under 40 in Washington by the National Law Journal. Corkran earned her J.D. from the University of Chicago Law School.

Corkran is also enthusiastic about her new position. She was attracted to the firm because of its reputation for creativity, and because it “rethinks cases from the ground up.†The firm “has an extraordinary record in high-stakes cases, and I was immediately attracted by the breadth of talent on this team.â€

Two other clerks who were members of Corkran’s class will join the firm as associates: Ian Fein and Daniel Rubens. Fein earned his J.D. from UC Berkeley School of Law and was a clerk for Justice Elena Kagan. Fein also worked as a journalist for five years before pursuing law school. He has also clerked for Judge Judith Rogers of the U.S. Court of Appeals for the District of Columbia Circuit and Judge William Fletcher of the Ninth Circuit. Rubens clerked for Justice Ruth Bader Ginsburg during the last term, and previously clerked for Judge Robert Katzmann of the Second Circuit. He has also worked as an associate with Wachtell, Lipton, Rosen & Katz.



Kevin Arlyck graduated from NYU School of Law and was a clerk for Justice Sonia Sotomayor. He also clerked for Judge Robert Katzmann of the Second Circuit. He has a doctorate in history and, before attending law school, taught social studies in a New York experimental school, as well as in Louisiana for Teach for America.

Nicholas Bagley is an assistant professor at the University of Michigan Law School and joins the firm as special counsel. As a professor, he teaches and writes in regulatory theory, health law, and administrative law. He was an attorney with the Justice Department’s civil appellate staff. While working as a staff attorney, he argued twelve cases before courts of appeals and was lead counsel in several more. He clerked for Justice John Paul Stevens. He also participated in the Teach for America program, and taught eighth-grade English at a public school in the South Bronx.
