A Delaware man woke up from a colonoscopy to find himself dressed in pink women’s underwear. Now he’s suing.
Andrew Walls, 32, filed the suit just two days before the statue of limitations wore out: the incident, apparently some sort of prank, took place in 2012, at the same hospital Walls worked.
“When the plaintiff recovered from the effects of the anesthesia administered by defendants, he awoke to realize that while he was unconscious pink women’s underwear had been placed on his body,” the suit reads. “When the plaintiff initially presented for his colonoscopy he had not been wearing pink women’s underwear and at no time did the plaintiff voluntarily, knowingly, or intentionally place the pink women’s underwear upon himself.”
“The defendant’s extreme and outrageous conduct went beyond all possible bounds of decency,” claimed his attorney, Gary Nitsche, in the complaint. Despite the drastic language, it doesn’t take too nefarious of an imagination to imagine something more “extreme and outrageous.”
Nevertheless, apparently Walls lost his job over “severe emotional stress,” as the New York Daily News reports. The suit is seeking damages over emotional stress, mental anguish, and loss of wages and earning capacity.
