Summary: After driving under the influence and striking another car, killing one of the passengers inside, actress Amy Locane was sentenced to three years in jail.
Actress Amy Locane from ‘Melrose Place’ struck another vehicle while drunk, killing the female passenger and seriously injuring the male passenger. Now the lawyers for both sides are arguing over whether Locane must appear at a deposition when an appeal for a related criminal case is ongoing.
Her lawyer in the civil suit has asked for the deposition to be delayed until the appellate remedies are drained or for a stay on the case. The lawyer for the plaintiffs, the husband and son of the 60-year-old woman killed in the accident, claims that Locane must appear for the deposition but can plead the Fifth on questions. Until a question has been asked and the Fifth invoked, the court can’t determine the eligibility of the Fifth Amendment privilege.
In June 2010, Locane left a party and struck a car with Helene and Fred Seeman inside their son’s home. The Seeman’s have named Locane’s husband Mark Bovenizer and the hosts of the party, Rachel and Carlos Sagebien, as defendants in the case. She had attended a party celebrating a local theater production coming to an end and then went to another party where she drank more.
Locane was sentenced to three years in jail for vehicular homicide and assault by auto. She could have received ten years in jail but the Superior Court judge was lenient since Locane has young children. The Seeman family believed this sentence was not fair and appealed the sentence.
She was given the deposition notice June 19 but gave her notice that she would not appear for it on June 23.
