In Queens, New York, a straight teacher alleges that he was discriminated against by his gay principal for his sexual orientation.

Lane McDonough of Bayside claims that when he was interviewed by Principal Paul Didio in June of 2014, Didio made strange remarks about not liking to hire men. Didio allegedly told McDonough that he had a “bad experience” with working with males. “I gave a male teacher a bad review, and he retaliated by accusing me of soliciting [oral sex],” Didio supposedly said.

McDonough’s lawsuit claims Didio is gay.

The lawsuit further states that Didio decided to take a chance on McDonough because he mistakenly assessed that McDonough was gay too. It was only after hiring McDonough to teach fifth grade did Didio realize that his gaydar was off. The former substitute teacher with degrees from Queens College revealed to the principal that he was straight, and that’s when the alleged harassment began.

The New York Post reports, “Didio forced McDonough to switch grades a month into the school year, ridiculed him for being unprepared, subjected him to numerous informal observations, and even reprimanded him for boxes left by another educator in McDonough’s classroom, according to the lawsuit, which McDonough filed last week in Manhattan Supreme Court against the city Department of Education.”

McDonough was still in his probationary work period when he was fired. He wants his termination to be reversed, and the city will review the allegations.

This is not the first time that a New York teacher has sued because of his heterosexuality. In 2013, Gregory Kenney, a straight and married gym teacher who taught at Trinity, a fancy Upper West Side private school, claimed he was fired by his lesbian boss because she hated his “traditional family status.” The school countersued months later and alleged that he was fired because he was too busy cheating on his wife and didn’t do his job.

That case is still pending. Kenney is represented by The Law Office of Steve A. Morelli, PC, and Trinity School is represented by Seyfarth Shaw, LLP.
