Summary: Trader Joe’s is slapped with a class action lawsuit for underfilling cans of tuna.
When you sell fish, you better give customers the amount they paid for, or they’re going to sue.
That’s what happened to Trader Joe’s. Tuna enthusiasts have filed a lawsuit a class action against the popular grocery store, The New York Post reports. The fish lovers accuse the company of not filling their 5-ounce cans of tuna all the way, thus “cheating” them.
This week the lawsuit was filed in Manhattan federal court, and it stated that government tests show that the cans of Trader Joe’s tuna actually only holds 3 ounces of fish.
“Every lot tested, and nearly every single can, was underfilled in violation of the federally mandated minimum standard of fill,” the lawsuit said.

The test examined 24 cans of Trader Joe’s tuna and found the Albacore Tuna in Water Half Salt held on average 2.43 ounces of cake tuna. The federal mandate for a minimum fill is 3.23 ounces.
The US National Oceanic and Atmospheric Administration conducted the tests.
Trader Joe’s declined to comment to the New York Post on the story because they do not comment on pending litigation. Well, on the bright side, at least some of the heat is taken off of Whole Foods. (See Whole Foods to Pay Money Back.)
