Get Bit by K-9, Receive $2 Million

Summary: A young woman was bit by a sheriff office’s K-9 that escaped from the patrol car and will receive a $2 million settlement.

Police K-9s are trained to bite, not lick or even nip, which one California woman found out the hard way. Erin Casey, 21, was engaged in an argument in an Oildale parking lot when a Kern County sheriff deputy happened upon her. He stopped to provide assistance if needed when his German shepherd got loose.

Casey’s attorney, Matt Clark of Chain Cohn Stiles, explained how the dog got out, “The dog uses its nose to open the slider, gets into the front seats and then jumps out of an open window. There as a defect in the door. Normally, the dog could not open the door on its own.” The deputy was unable to get the dog under control, being forced to call for backup to get the dog off Casey.

Clark announced that the settlement is the largest of its kind for a dog bite case in California against a public entity. The award of $2 million was high to account for the injuries Casey suffered, including nerve damage and spinal cord treatment. “She’s certainly not 100 percent. I don’t know if she’d ever be 100 percent,” Clark said. “No amount of money takes away the fact that she’s in pain every day.”

The settlement with Kern County will come from taxpayer dollars.
