Trump Model Management LLC told the federal government that Palmer would be paid a $75,000 yearly salary for her job in the United States. Palmer claims she was only paid $3,880.75 for the three year contract. She is seeking $225,000 in back pay for the company’s “fraudulent representation” and violations of the U.S. immigration and labor laws.

The modeling agency filed for dismissal in October 2014, leaving a decision as to whether the case will move forward to the U.S. District Court, Southern District Judge Analisa Torres. If the case does move forward, it will draw attention to how Trump will deal with foreign labor practices.

Lawyers for Trump claim the lawsuit is “frivolous” and lacks merit because Palmer was more than adequately paid for her short time as a model. They claim she only worked at most ten days over the three years. Palmer’s attorney, Naresh Gehi, states the company cheated her of money and “the visa application the company filed with the government requires that people are paid the full amount. It’s a requirement.”

Trump owns the agency but is not directly named in the lawsuit.
