The attorneys for Hulk Hogan are asking for a lot from the jurors deciding the fate of his lawsuit against entertainment website Gawker. Hogan has sued Gawker for tens of millions of dollars for posting a sex tape featuring the former professional wrestler without his permission.

The six-member jury was told by attorney Kenneth Turkel that the editors at Gawker lacked the “common decency” to seek a comment on the tape from Hogan before posting the video. Lawyer Michael Sullivan for Gawker fought back claiming the gossip and news website has a right to the First Amendment to publish legitimate new stories despite how objectionable the content may be. Jury members must now decide if the sex tape was newsworthy or should have considered a celebrity’s right to privacy.
During his testimony, Hogan claimed the video of him having sex with the wife if his best friend at the time caused him lasting humiliation. The encounter was unknowingly taped inside of his friend Bubba “the Love Sponge” Clem’s home nearly ten years ago.
Gawker edited the video down to less than two minutes with only nine seconds of content that was sexually explicit. According to the editor, the video was supposed to serve as a commentary on celebrity sex tapes.
Hogan has not been shy about his sex life in the past, discussing details in public but no other sites that have written about it have posted a video. Hogan claims that his real-life persona should be protected from the public when in the privacy of a friend’s bedroom.
