Summary: The ACLU with the partnership of Planned Parenthood is seeking to stop a new abortion law in Indiana from being implemented.
On behalf of Planned Parenthood of Indiana and Kentucky, the American Civil Liberties Union of Indiana has filed a lawsuit against Indiana’s new abortion law. The ACLU and PPINK claim the new law, House Enrolled Act 1337, is an “unprecedented and unconstitutional” invasion of privacy.
ACLU of Indiana executive director Jane Henegar said, “The ACLU stands firmly against discrimination in all forms, but that isn’t what this law is about. Unnecessary restrictions, like those recently signed into law, demean women and threaten the quality of their health care. The ACLU of Indiana will continue to work to ensure that every woman can make the best decision for herself and her family about whether and when to continue a pregnancy without undue political interference.”
The lawsuit is seeking an immediate injunction against this law, which will ban abortions due to fetal genetic abnormalities, race, sex, ancestry, and requires the only way to dispose of an aborted baby is through cremation or burial.

The lawsuit goes on to state, “It is similarly irrational to impose burial and cremation requirements on fetal tissue after a first trimester abortion if the abortion occurs within an abortion clinic or health care facility and the clinic or facility is requested to keep the fetal tissue by the woman having the abortion, but not if the woman elects to retain the fetal tissue herself.”
Indiana Right to Life President Mike Fichter countered the lawsuits argument, “Planned Parenthood’s lawsuit against the Dignity for the Unborn law comes as no surprise…They oppose any common sense law that protects women and children because they want to protect their bottom line.” Fichter is referring to the revenue Planned Parenthood makes each year from performing abortions.
Legal attempts in other states to restrict abortions have been halted by the federal courts.
