Can Taylor Swift Win a Lawsuit Against Kanye and Kim Kardashian West?

Summary: Kim Kardashian leaked a video of Kanye West speaking to Taylor Swift about his song “Famous” before its release.

To fans of the cult of celebrity, no one escaped the drama that was Kanye and Kim Kardashian West versus America’s former sweetheart, Taylor Swift. For everyone else, the feud was still hard to ignore as various aspects of the story trended on social media. To recap, Kim Snapchatted a video recording between Swift and Kanye, and the video seemed to debunk Swift’s claims that Kanye had never asked for her approval in regards to the song, “Famous.” Now people are speculating whether litigious Swift will file a lawsuit against the high-profile couple.

The song “Famous” featured the lyrics, “I feel like me and Taylor might still have sex. Why? I made that bitch famous.” Swift famously condemned the work at the Grammy’s and in a statement to Buzzfeed, and Kanye and Kim were both outspoken that Kanye had asked Swift for approval of the song and had actually given her blessing. In an interview in GQ Magazine, Kim claimed Kanye had footage of the phone call between Swift and Kanye that proved Swift was a liar.

Now that the video has gone viral, people are wondering if Swift will sue. Not because she is embarrassed or because Kanye appropriated her name in his music, but because California is a two-party consent state when it comes to private recordings.

Swift reportedly has already considered suing the couple, but has yet to file officially. Commentators have speculated that Kim, being a shrewd businesswoman and the daughter of O.J. Simpson’s Dream Team lawyer Robert Kardashian, would never be so stupid as to not check the legality of leaking a tape of one of the world’s biggest pop stars.

California law protects “confidential communication,” but TMZ reported that Swift had no expectation of privacy when it comes to conversations that “may be overheard.” In the video, Kanye speaks to Swift over a speakerphone and producer Rick Rubin is in the room and sometimes chimes in, letting Swift know he is there, listening. At the time, Kanye was also filming a documentary, and there were cameras and recording devices that followed him everywhere he went.

TMZ concluded, “There’s no doubt listening to the full tape … Taylor knew she was being overheard. As a result, it’s pretty clear … Kanye didn’t violate the law by recording it.”

Additionally, Kanye is married to Kim, a reality star; and it is safe to assume that any interaction with her or her family will result in guilty-pleasure entertainment, and that is definitely what happened here.
