Playmate Could Lose $1M after Snapchatting Photo of Unsuspecting Nude Woman

Dani Mathers’ Snapchat drama is getting uglier. The Playmate infamously took a photo of an unsuspecting naked woman in the gym locker room earlier this month and then published it on her Snapchat. Now, the model could lose up to a million dollars in a lawsuit, an entertainment attorney told The Wrap.

Devin McRae, an entertainment litigator with Early, Sullivan, Wright, Gizer & McRae, told The Wrap that Mathers could face a civil lawsuit worth up to seven figures. However, it is all dependent on whether or not the victim will come forward, and as of now, she has yet to identify herself.

Earlier this month, Mathers was inside of the locker room at L.A. Fitness in Universal City when she saw a naked older woman near the shower area. Seemingly shocked to see an average-sized body, the model secretly took a photo of the woman and put the caption, “If I can’t unsee this then you can’t either” before publishing it online.

The fall out from her mean-spirited post was swift. Angry users called out the model, she lost her radio hosting gig, and L.A. Fitness banned her from all locations. The gym also reported her to the Los Angeles Police Department, who are conducting a criminal investigation. Mathers immediately apologized after the incident, but her apology was considered weak as she tried to excuse herself, saying that the picture was only for a friend, not for the public.

According to McRae, the anonymous victim could sue Mathers for several counts. McRae said the woman could sue not only for invasion of privacy and intentional emotional distress, but she could also sue under California’s “Revenge Porn” law. The law was introduced in July 2015 as a means to counteract the growing problem of people who posted private sexually explicit content of people they knew.

The LAPD told The Wrap that the victim has not forward to press charges. McRae said that under the Revenge Porn law the victim could file anonymously as “Jane Doe.” She added that if the victim were to sue, she would most likely win as the public perception of Mathers is that she is a terrible, cruel person.

“It would be a hard case for this Playmate to defend, because she’s not going to get any real sympathy,” McRae said.
