Summary: “Jane Doe” is suing her plastic surgeon for posting before-and-after pictures of her boob job on their website without her permission.
Plastic surgeons use before-and-after photos to showcase their work and win over new clients. However, before they can post, they have to get permission. While a lot of clients are happy to show off their new boobs or round butt, one Illinois woman said she was horrified to find her fake breasts plastered on her doctors’ website.
According to The Chicago Tribune, the plaintiff said she “specifically refused” her doctors’ request to post her pictures but that they had done it anyway. In her lawsuit which was filed in Cook County Circuit Court, she said that she has a “highly distinctive freckle pattern on her chest” that her friends and family could easily recognize.
The woman said she felt “intense fear” at being discovered by her inner circle, and she is suing for $50,000. She said that when she found the photos on the doctors’ website, A New You Plastic Surgery & Laser Center, she felt “shocked and “humiliated.”
The photos had been posted on the website for over a year before the plaintiff learned of them. Her attorney, Kevin O’Brien, said that she had told her cosmetic surgeon, Dr. Rajendra Shah and his son Dr. Samir Shah, to not use her images for marketing and promotional purposes. Her lawyer said that after she contacted them about the images they removed them from their site.

The woman, who is a mother in the Chicago-area, said that she had visited the Shahs’ office in 2015 and had been presented with two waivers, one for medical photography and one to allow the photos to be used for marketing. She said she signed the waiver to allow the former but had not consented to the latter.
The plaintiff said that she had undergone a procedure in June 2015 and that photos of her exposed torso were taken on Rajendra Shah’s iPhone.
Dr. Rajendra Shah’s lawyer told The Chicago Tribune that this incident was a misunderstanding.
“Dr. Shah regrets the misunderstanding that led to this problem,” Glenn said in a statement. “The photographs were taken down immediately upon her request. Efforts are being made to amicably and professionally resolve the problem.”
According to Yelp, “Rajendra R. Shah, M.D. has practiced in the Chicago area for most of his medical career. Dr. Shah completed his surgery residency at Rush-Presbyterian-St. Luke’s Hospital in Chicago, IL before entering the plastic surgery residency program at Ohio State University in Columbus, OH. After finishing residency, Dr. Shah returned to the Chicago area where he opened private practice and has been a member on staff at Christ Hospital since 1983.”
