Summary: An emotional Rob Kardashian posted nude photographs of his on-and-off again girlfriend Blac Chyna, and legal experts warn that he may be guilty of “revenge porn.”
On Wednesday, sock entrepreneur Rob Kardashian was banned from Instagram because he posted several nude images of his baby’s mama. He then moved to Twitter to share several emotional tweets about how his estranged lover used and cheated on him, and legal experts said that he could see jail time for posting “revenge porn.”
“Revenge porn” is the act of publishing nude images or video of a lover without their consent, and in California, where Kardashian and his ex Blac Chyna live, a first-time revenge porn offender could receive up to six months in jail and a $1,000 fine.
Meaghan Zore, a California lawyer who specializes in technology laws, told AOL that to be convicted of a criminal charge involving revenge porn, malicious intent must be established.
“The issue will be establishing that he knew or should have known it would cause her distress and that she actually suffered emotional distress as a result,” Zore said. “Based on the comments he posted alongside the images/videos, it certainly seems that he intended to cause her emotional distress.”
Attorney Erica Johnson told AOL that Chyna could also file a civil lawsuit against Kardashian and that these types of cases could be worth a lot of money. She said that unlike criminal cases, intent is not required to prove.
Rob Kardashian, the brother to Kim Kardashian and one of the stars of Keeping Up with the Kardashians, started dating Blac Chyna in early 2016. However, the two had known each other before their romantic relationship started. Kardashian’s half-sister Kylie Jenner dated Blac Chyna’s former boyfriend and baby’s daddy, Tyga; and many saw Kardashian and Chyna’s relationship as an epic form of family revenge.
Kardashian and Chyna appeared happy in the beginning of their romance, and in May of 2016, she announced she was pregnant. The two had their own reality show which documented their relationship, but as time passed, it became evident that the two dramatic people were not compatible.
In December, Chyna moved out of the couple’s home (which actually was owned by Kylie Jenner), and Kardashian said on his Wednesday Twitter rant that the couple’s problems stemmed from her infidelity.
Before Kardashian’s account was disabled, he had 9 million Instagram followers, and he has almost 8 million on Twitter. His pornographic images of Blac Chyna were taken down by both sites, but they were up long enough for some of his audience to see them.
Attorney Lisa Bloom of Los Angeles wrote on Twitter that Kardashian’s actions were illegal and abusive.
“Revenge porn is a crime, a civil wrong, a form of domestic partner violence, and a violation of social media’s terms of use. And truly sick,” Bloom said.
Chyna’s lawyer Walter Mosley told E! News that Kardashian’s ex is looking into her options.
“We are taking this assault against Chyna very seriously and exploring all of the legal remedies available to my client at this time,” Mosley said.
