An unnamed actress has filed a lawsuit against Harvey Weinstein for an incident that occurred in a Beverly Hills hotel room in 2015 and 2016. The actress is alleging sexual battery in her lawsuit filed in the Los Angeles Superior Court.
The actress says she met the producer at the hotel to discuss the television role. She claims she was held against her will while Weinstein engaged in sexual situations with her. The woman explains in the suit that she first met him in 2011 at a party where he offered to help her with her acting career. For several years after that, he would continue to invite her to awards show parties.
The lawsuit says Weinstein met her at the Montage Hotel in late 2015 to discuss a part in the movie “Marco Polo,” which Weinstein and his company are producing. The producer asked to masturbate in front of her but she refused. He then held her by the wrist and forced her to watch him.
Months later she agreed to meet him at the same hotel to discuss the role again. She claims that this time he threw her on the bed and performed oral sex on her before putting his penis in her vagina and then masturbating on her. She was eventually able to break free and escape the room.
Weinstein’s representative Holly Baird said, “Any allegations of non-consensual sex are unequivocally denied by Mr. Weinstein. Mr. Weinstein obviously can’t speak to anonymous allegations, but with respect to any women who have made allegations on the record, Mr. Weinstein believes that all of these relationships were consensual.”
The actress, who also names his company The Weinstein Co. in the suit, is seeking unspecified damages. His company fired him after the allegations of sexual harassment started turning up and a detailed expose appeared in The New York Times a month ago.
Once again, the actress claims that the company knew of his sexual harassment and abusive behavior but showed “deliberate indifference” to his actions. Gloria Allred, who represents several of Weinstein’s accusers, filed the lawsuit.
Weinstein is being investigated in Los Angeles as well as New York and London for possible criminal prosecution in relation to other allegations of sexual harassment and assault. With all the allegations rising from Hollywood women, the Los Angeles County District Attorney’s office has established a special task force to handle future criminal complaints. The advocacy group Women in Film also plans to establish a helpline and panel of pro-bono legal experts.
Weinstein has apparently checked into a rehab center in Arizona to deal with his assumed sex addiction and other problems.
