Tucson Attorney Scott Lieberman Disbarred for Sexual Misconduct

Summary: The Arizona State Bar decided to disbar an attorney after multiple sexual allegations were raised against him.

A Tucson attorney accused of sexual misconduct has been disbarred by the Arizona State Bar. Scott Lieberman, 45, allegedly sent a female client an image of his genitals in a text with the offer to cancel her bill if she had sex with him as well as other inappropriate actions, according to the Arizona Daily Star.

The state bar made their announcement Thursday to disbar Lieberman after he had been investigated at least three times in the last six years for sexual misconduct with clients. One of the allegations against him involved lewd conduct with a female client he represented in a child custody case. The statement read, “During representation, Lieberman sent his client a text message asking her, ‘would you rather have sex and not pay at all?’”

The statement further read, “He made similar statements to his client over the phone and sent at least one text message with a picture of his genitals.” The woman is not believed to have taken Lieberman up on the offer seeing as how he “was paid $17,000” for his work on her case.

The other misconduct charges filed against Lieberman, which were used as reasons for his disbarment, include failure to comply with several superior court orders, abandoning a client who paid him a $5,000 retainer to handle a child custody case, and failure to file a final order on a client’s behalf.

Less than a year ago, Arizona suspended his license for three years for having a sexual relationship with another female client. He was also accused of lying during a 2012 sexual misconduct investigation to a state bar investigator. In that investigation, “Lieberman informed the state bar that he had never had a sexual relationship with a client. That assertion was false,” according to the bar ruling in 2017.

In the state of Arizona, a disbarred attorney is not allowed to be in the legal business for a minimum of five years. After five years, a disbarred attorney can seek permission from the state supreme court to be allowed to practice law again.

Lieberman was admitted to the state bar in 2006, according to his state bar profile. He graduated from Capital University Law School in Ohio in 2000.
