The Complainant: Jean E. Dassie

What
Where

Jean E. Dassie, a naturalized citizen from Cameroon, is at the heart of this legal battle. The lawsuit revolves around his claims of discrimination within the firm, focusing on his interactions with counsel Anh-Khoa Tran, who is also named as a defendant in the case. Dassie contends that his grievances with the firm are closely linked to his disagreements with Tran.

A Disagreement on Protocol Turns Sour

At the center of this legal feud is a conflict that erupted in 2022 concerning the protocol for making changes to slideshows intended for use in trials. Dassie found himself at odds with Tran over the proposed approach for this task, asserting that Tran’s proposal lacked practicality. Nevertheless, Dassie conveyed his willingness to consider Tran’s ideas. However, instead of a reasoned exchange of ideas, the situation took an unpleasant turn when Tran, according to the lawsuit, “scream[ed] at plaintiff that he is a counsel and that if he wants something done one way, that’s how it should be done.”

Negative Evaluation Casts Shadows

Tran’s account of the altercation would later become the foundation for a detrimental year-end evaluation, delivered in September 2022. The assessment led to Dassie being placed on an interim review plan, further exacerbating the discord. WilmerHale’s evaluation of Dassie indicated that he “continued not to follow the instruction, which led to an altercation inconsistent with WilmerHale culture and values.”

Defamatory Claims and Alleged Pretext for Termination

In response to the evaluation, Dassie’s complaint argues that the statements contained within it are defamatory. It asserts that “Blinded by its prejudice, WilmerHale accepted Tran’s version of events uncritically and published the falsehoods in the plaintiff’s year-end evaluation.” This alleged defamation is a significant point of contention in the lawsuit. Dassie further contends that although he received above-average evaluations for the remainder of 2022 and throughout 2023, this negative review was used as a “pretext” to terminate his employment.

Additional Allegations of Mistreatment

The complaint also raises concerns about Dassie being assigned menial tasks below his position and being wrongly blamed for mistakes that were not his own. These allegations add further complexity to the ongoing legal battle.
