Summary: Sofia Vergara has filed court documents to block her ex Nick Loeb from pursuing parental custody of their frozen fertilized eggs.
Sofia Vergara has been fighting her ex for two years over the right to their frozen human embryos, and now Vergara is asking the courts to stop the madness. According to TMZ, she filed documents to officially block Nick Loeb from trying to take control over the embryos. She stated that he intends to bring them to term, even though they had a signed agreement that neither one could do anything without mutual consent.
The Modern Family actress was engaged to Loeb when they created the embryos in 2013. Â They had intended to get a surrogate and bring the embryos to term but the pair split in May of 2014. Later that year, Loeb sued Vergara for custody of the fertilized eggs because he did not want her to destroy them. He dropped his case that December after a California judge sided with Vergara.
However, Vergara believed that Loeb dismissed his case because he wanted to refile in another state and waste her time. Thus, she recently filed court papers so that Loeb could no longer pursue custody. She is also asking for monetary damages, claiming Loeb acted on “malicious intent” in seeking to break the contract.
Since her breakup with Loeb, Vergara has moved on and married True Blood hunk Joe Manganiello. She has said publicly that she has no intention of destroying the embryos that she and Loeb had created, but she does not want to have children with her ex.
Vergara reportedly makes $250,000 per episode of Modern Family. According to The Mirror, Loeb wants the embryos so that his future children can have access to a trust that will fund their education and other expenses.
