Summary: Demi Moore has asked a judge to dismiss the wrongful death lawsuit filed against her and her Beverly Hills home.

Demi Moore is fighting a lawsuit that said she’s responsible for the death of a young man who drowned on her property. The actress was not present during the accident, but the man’s family states her home was unsafe.

In July of 2015, Edenilson Valle, 21, attended a party at Moore’s house in Beverly Hills, and the party was thrown by her assistant and an associate. After drinking, Valle tripped over a rock and fell into the pool. The non-swimmer drowned in the deep end, and his parents said that the location was dangerous.

“There were no depth markers or any safety signage in the 10-foot-deep pool, there were rocks around the pool which created a trip hazard,” the lawsuit said.

Moore, 54, was out of the country when the party occurred, and she asked the judge to throw out the Valle family’s wrongful death lawsuit because she had no responsibility for his death. The lawsuit was originally aimed at the trust who owned the house but it later added the Empire actress and Austin Powers producer as a defendant.

Moore said that Valle’s death was caused by his negligence and that he was on her property illegally. She said that he knowingly and voluntarily assumed the risks that were at the party, and he had chosen to drink and hang out by the pool even though he couldn’t swim. Valle’s parents said that he had been forced to navigate a perilous environment.

Valle’s parents said that the pool was dark and had an unmarked deep end, dangerous walkways, and tripping hazards. They said that the pool was heated to 101 degrees, which they alleged could cause brain damage.

Valle’s parents also criticized the party for having alcohol.

“House manager Lenny Hernandez knew there was drinking that night, and in fact, she was serving alcohol at a party which was unsafe to host,” the parents’ lawsuit said.

At the time of the death, Moore had expressed her “shock” and offered her condolences to the Valle family.

“The loss of a child is an unthinkable tragedy and my heart goes out to this young man’s family and friends. I ask that you please respect the privacy of all concerned during this sensitive time,” Moore had said.

Authorities did not suspect foul play, and they stated it appeared Valle had drowned because he couldn’t swim. Most of the partygoers had left when his body was found at the bottom of the pool, according to The Daily Mail.

The Valle family is seeking damages of $25,000.

Demi Moore is an actress who recently appeared in Fox’s hit show Empire, and she has starred in films such as St. Elmo’s Fire, Striptease, Indecent Proposal, and G.I. Jane. She was previously married to Bruce Willis and Ashton Kutcher, and she has a reported net worth of $150 million.
