Jim Carrey wants to clear his name, which has been smeared with allegations of drug use and herpes. This week, a judge granted the funnyman permission to use Cathriona White’s medical records in the blistering lawsuit filed against him, and this could mean a win for the actor, according to The Mirror.
Carrey, 55, dated Irish makeup artist Cathriona White on-and-off from 2012 to 2015 and White killed herself in 2015 by overdosing on prescription drugs. She was 30 when she took her life.
Her estranged husband Mark Burton and her mother Brigid Sweetman said that Carrey had supplied White with the drugs that had killed her, and they said she had spiraled into depression because he had infected her with herpes and then dumped her. They claimed he had used his “wealth, influence, and celebrity status” to hurt White.
Carrey has denied the allegations and his legal team said that White had a boob job before her death and was given a prescription for painkillers. His defense team had requested that White’s medical records be used in this case, and on Tuesday, Los Angeles Judge Deirdre Hill granted his request.
“One of the issues is her prescription medication. We know she had breast surgery that month, we know she had oxycodone prescribed to her that month,” Carrey’s attorney Raymond Boucher said.
Carrey’s team wants the medical records to show proof of the breast surgery as well as evidence that she had contracted a sexually transmitted disease before her relationship with Carrey, who is worth $150 million.
“We want to be able to establish that Mr. Carrey absolutely did not transmit any herpes and he did not give her his pain medication and she could access her own,” Boucher said.
While Carrey’s team views Tuesday’s decision as a small victory, the plaintiff’s attorney, Michael Avenatti, said that Carrey’s medical records could also be made public in this case. The plaintiffs’ side had argued that Carrey had given White herpes 1 and 2 in 2013 after he had tested positive at a clinic using a fake name.
“We are pleased because now the same standard will apply to Mr. Carrey. He should be very nervous,” Avenatti said to The Mirror.
White’s family filed a wrongful death lawsuit against Carrey using California’s Drug Dealer Liability Act. They claim that he had given her access to the prescription drugs that had killed her, and he denied the allegations.
As part of the family’s evidence, they submitted a letter written by White to Carrey, which seemed to imply that she had killed herself because of their breakup and herpes.
“I will always be damaged goods, have a stigma attached,” White said.
Carrey and White’s family will square off in court for 20 days in April of 2018.
